Big Sky Dragons - Terms and Conditions

1. Eligibility and Buyer Representations

By placing an order, Buyer represents and warrants that:

Buyer is at least 18 years of age (or the age of majority in Buyer’s jurisdiction);
Buyer is legally permitted to own, possess, and import the reptile species purchased in Buyer’s state, county, and municipality; and
Buyer is solely responsible for verifying local, state, and federal laws regarding reptile ownership prior to purchase. Big Sky Dragons is not responsible for a Buyer’s failure to comply with local ownership laws, and no refund will be issued on this basis once the animal has shipped.

2. Payment Policy

Full payment is required before any animal will be shipped or reserved, unless otherwise agreed in writing signed by both parties.
Deposits are non-refundable, except where Big Sky Dragons is unable to fulfill the order as agreed (e.g., the specific animal dies, becomes unavailable, or is misrepresented prior to shipment). In such cases, Big Sky Dragons will, at Buyer’s election, provide a full refund of the deposit or apply it toward a comparable animal.
Big Sky Dragons reserves the right to decline or cancel a sale at any time prior to shipment, for any lawful reason, including but not limited to concerns about buyer suitability, husbandry conditions, or animal welfare. Big Sky Dragons will not refuse a sale on any basis prohibited by applicable law. If a sale is declined or cancelled by Big Sky Dragons after payment has been received, Buyer will receive a full refund of all amounts paid.

2A. Buyer Cancellation

If Buyer cancels an order after payment or deposit has been made, the deposit is forfeited as agreed in Section 2. Any remaining balance paid beyond the deposit will be refunded, less a 10% restocking/administrative fee, provided the animal has not yet shipped. Once an animal has shipped, no cancellation is permitted and Section 4 (Live Arrival Guarantee) governs exclusively.

3. Shipping Policy

Animals are shipped exclusively through approved live-animal shipping services selected at Big Sky Dragons’ discretion.
Shipping dates are scheduled based on safe temperature and weather conditions at both the origin and destination, as reasonably determined by Big Sky Dragons. Big Sky Dragons may delay shipment for animal safety at its sole discretion, and such delays do not constitute breach of this agreement.
Shipments are typically routed for secure carrier-facility pickup rather than direct residential delivery, to reduce transit stress and temperature exposure.
Risk of loss transfers to Buyer upon the carrier’s acceptance of the animal at the point of origin. Big Sky Dragons will provide dated photo and/or video documentation of the animal’s condition immediately prior to shipment, which shall serve as the baseline health record for purposes of any Live Arrival Guarantee claim.
Buyer is responsible for providing accurate shipping and contact information. Delays or failures caused by inaccurate Buyer information are not the responsibility of Big Sky Dragons.

4. Live Arrival Guarantee (“LAG”)

Subject to full compliance with the conditions below, Big Sky Dragons guarantees that the reptile will arrive alive and in good health.

Conditions of coverage:

The shipment must be picked up from the designated carrier facility within 30–60 minutes of arrival notification.
Buyer must provide clear photo and/or video documentation of the reptile to Big Sky Dragons within 90 minutes of the shipment’s arrival at the carrier facility, regardless of actual pickup time. Documentation must be sent to the owner of Big Sky Dragons by text message or Instagram direct message, using the same contact method used to coordinate your shipment; time-stamping is based on when the documentation is received.
Any health or condition concerns must be reported to Big Sky Dragons through the same contact method within that same 90-minute window, with supporting documentation attached.
After pickup, the reptile must not be exposed to unsafe temperatures, direct sunlight, unattended vehicles, or other hazardous conditions.

Failure to satisfy any of the above voids LAG coverage in full, including eligibility for replacement, refund, or any related claim.

Remedy if a valid claim is made:

If Buyer complies with all conditions above and the animal is confirmed (via submitted documentation) to have arrived deceased or in materially compromised health directly attributable to shipping, Big Sky Dragons will, at its sole discretion, provide one of the following: (a) a replacement animal of comparable value, subject to availability, or (b) a refund of the purchase price paid for that animal, excluding shipping costs. This is Buyer’s sole and exclusive remedy under the LAG.

Buyer acknowledgment:

By completing purchase, Buyer acknowledges having read and understood the pickup and documentation windows above and agrees they are reasonable given the welfare risks of extended transit exposure.

5. Disclaimer of Warranties

Except for the express Live Arrival Guarantee set forth in Section 4, the animal is sold “as is.” Big Sky Dragons disclaims all other warranties, whether express or implied, including the implied warranties of merchantability and fitness for a particular purpose.

Descriptions of genetics, morphs, lineage, or projected traits are provided in good faith based on available records but are not guaranteed unless expressly confirmed in writing for the specific animal purchased.

6. Exclusions — Not Grounds for Refund or Replacement

The following are considered normal and are not covered by the LAG or eligible for refund/replacement:

Minor cosmetic imperfections;
Normal shedding behavior;
Temporary relocation/transit stress;
Temporary refusal to eat following shipment.

7. Buyer Responsibility After Delivery

Once the reptile is in Buyer’s possession, all husbandry, veterinary care, housing, and ongoing welfare are Buyer’s sole responsibility. Big Sky Dragons is available for husbandry guidance but is not liable for outcomes resulting from Buyer’s care practices.

8. Force Majeure

Big Sky Dragons is not responsible for carrier delays, acts of nature, extreme weather, government action, agricultural or wildlife agency holds/quarantine/seizure, labor disputes, shipping interruptions, or other circumstances beyond its reasonable control. Big Sky Dragons will make commercially reasonable efforts to assist Buyer in resolving issues arising from such events, but such events do not give rise to a claim under the LAG or otherwise.

9. Limitation of Liability

To the maximum extent permitted by law, Big Sky Dragons’ total liability arising out of or related to any sale shall not exceed the purchase price paid for the animal at issue. In no event shall Big Sky Dragons be liable for incidental, consequential, indirect, or punitive damages, including but not limited to veterinary costs, lost enjoyment, or emotional distress, even if advised of the possibility of such damages.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles. Any dispute arising out of or relating to a purchase from Big Sky Dragons shall be resolved through binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, with the arbitration seated in Lewis and Clark County, Montana. Judgment on the arbitration award may be entered in any court of competent jurisdiction. Each party shall bear its own attorney’s fees and costs, except as the arbitrator may otherwise award. Buyer and Big Sky Dragons each waive the right to a jury trial and to participate in a class action.

11. General Provisions

Entire Agreement: These Terms, together with any written agreement signed by both parties, constitute the entire agreement between Buyer and Big Sky Dragons regarding the purchase and supersede all prior or contemporaneous verbal representations.
Severability: If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
Amendment: Big Sky Dragons may update these Terms at any time; the version in effect at the time of purchase governs that transaction.
No Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
Manner of Acceptance: These Terms are enforceable, including the arbitration and class-action waiver provisions in Section 10, when Buyer affirmatively accepts them at checkout via the required agreement checkbox before purchase can be completed.
